Alberta > Dependent Adults Act > Guardianship:

Who are the "nearest relatives"?

There is a list of relatives in the Dependent Adults Act. They are in order of precedence:

  • husband or wife;
  • son or daughter;
  • father or mother;
  • brother or sister;
  • grandfather or grandmother;
  • grandson or granddaughter;
  • uncle or aunt;
  • nephew or niece.

Generally, in each class, the oldest person (e.g., the oldest child in a family) will take precedence.
