What if my wages on piecework or commission do not amount to the minimum wage?

Your employer must look at your pay period and determine whether over that period you are in effect getting less than minimum wage based only on commission or piecework rates. If your pay is less than minimum wage, the employer must pay you the difference to bring you up to minimum wage levels.

If your pay period is longer than one month, your employer must determine your pay based on one month.
