Some provinces have laws that deal with issues of family violence
or violence against vulnerable or neglected adults. The laws may
provide a way for the police or another authority to apply for emergency
orders from court to protect victims. In some provinces
the laws are about family violence or domestic violence, and in
other provinces the law may be about vulnerable or neglected persons
or adults. The law in your grandfather's province might not cover
the situation that he is in, particularly the laws that deal with
domestic or family violence. For example, some laws require that
the victim be living with the family member, which would not help
in all situations of elder abuse.
An emergency order may allow for your grandfather to be removed
from the house, or even for your uncle to be removed from the house.
Often, there has to be a court hearing a few days after the emergency
order to either confirm the order for a longer period or to discontinue
it. Emergency measures such as these are often available 24 hours
a day, so that they can be obtained during the night.
