Are the Guidelines always followed exactly? Do they apply in every situation?

No. The Child Support Guidelines don't apply when

  • there is a case of "undue hardship" (the paying parent convinces the judge he or she would suffer undue hardship by paying what the Guidelines require),
  • one spouse earns over $150,000 a year, or
  • the child for whom support is being paid is over the age of majority.
