How are child support payments affected if the children split
their time between the parents' homes?
The
Guidelines define shared custody as
a situation where each parent has the children at least 40% of the
time (either through access or physical custody) over the course
of a year. In cases of shared custody, child support is calculated
by
- looking
at the amounts set out in the Guidelines for each parent based
on income;
- any
increased costs of the parents because of the shared custody arrangement;
- the
childrens' circumstances and expenses as well as the circumstances,
expenses, and income of each parent.
The
final difference between the two amounts is the set off amount.
The parent who is required to pay the higher amount would pay the
set off amount to the other parent.
