Is it possible to opt out of using the Guidelines?
In
some circumstances it is possible for a court to disregard the Guidelines.
These include where
- an
agreement or order has made special provisions for a child and
the Guidelines would result in inequitable child support. The
court must give written reasons for such a decision.
- the
court is satisfied that reasonable arrangements have been made
for the child with the consent of the parents even if it is not
the same as the Guidelines — but the court will look at
the Guidelines in making that decision.
If
you have not gone to court about child support since your separation,
it is open to you to make your arrangements with regard to support.
However, the Child Support Guidelines can still operate as a guide
to what has been determined to be a reasonable level of support
payments.
