What is mental cruelty?

There is no general definition of what behaviour is considered "mental cruelty". Judges decide this by using the subjective test of looking at the specific spouses and the specific marriage in each case. Canadian judges have held that the following behaviour is mental cruelty:

  • persistent criticism and belittlement;
  • persistent and willful withdrawal of companionship;
  • refusal to have sexual relations; and
  • domineering or tyrannical behaviour.
