Are all divorces contested?No. Almost all divorce cases in Canada are resolved without having a trial before a judge. Usually spouses will have lawyers representing them and the lawyers will work out an agreement for their clients. It may not be perfect for either side but it will mean that there won't be a trial, which is both expensive and emotionally difficult for everyone. Once an agreement is reached, the divorce itself becomes a matter of paperwork, or in some provinces, a very brief hearing. June 2006 Back |
