If my divorce is contested, will I have to go to court?
Yes. If you can't reach an agreement with your spouse, either yourself or through your lawyer, then you will have to go to court and give evidence about your situation. A judge will make some decisions about what will happen. If you can't agree about who should have custody of your children, for example, then the judge will decide the question of custody.
